Agreement to These Terms

These Terms of Service form a binding agreement between you and Avante Studio LLC ("Avante Studio", "we", "us") covering your use of OnlyMenu IO. By creating an account or using the app you accept these Terms. If you do not accept them, do not use OnlyMenu IO.

Eligibility

You must be at least 13 years old to use OnlyMenu IO. If the law where you live requires a higher minimum age to use the service without parental consent, that higher age applies. By creating an account you confirm that you meet the applicable minimum age and that applicable law does not bar you from using the service.

Your Account

You are responsible for your account and for keeping your password and your encryption passphrase secure. Because your content is end-to-end encrypted, we cannot recover it if you lose your passphrase and have no valid key backup. Do not share your account, impersonate another person, or misrepresent who you are affiliated with.

No Purchases

OnlyMenu IO is currently free and contains no in-app purchases or subscriptions. If paid features are introduced we will update these Terms and, where required, obtain your consent before any charge.

Your Content and Licence

You keep ownership of everything you upload. You grant Avante Studio a limited, worldwide, non-exclusive, royalty-free licence to host, store, transmit and display your content for the sole purpose of operating OnlyMenu IO for you and the people you share with. That licence ends when you delete the content or your account, apart from copies held briefly in routine backups. You are responsible for holding the rights to whatever you upload.

Acceptable Use

You agree not to use OnlyMenu IO to post or share content that is illegal, sexually explicit, hateful, harassing, threatening, violent, defamatory, or that exploits or endangers a minor; to impersonate anyone; to send spam or unsolicited bulk messages; to infringe intellectual property or privacy rights; to offer goods you are not permitted to sell; to harvest other people’s data without consent; to interfere with or attempt to compromise the service; to reverse engineer, decompile or attempt to defeat the encryption or access controls; or to access the service by automated means.

Zero Tolerance for Objectionable Content

There is no tolerance for objectionable content or abusive behaviour on OnlyMenu IO. Every user can report content or an account from the in-app menus, block another user so that they can no longer make contact, and mute an account to stop its notifications. We review reports and remove violating content and eject the users responsible, ordinarily within 24 hours of a report. Severe or repeated violations lead to permanent termination.

Encryption and the Limits of Moderation

Because message and catalog content is end-to-end encrypted, we cannot see it and therefore cannot scan it proactively. Moderation depends on user reports, which is why reporting, blocking and muting are available from every direct conversation, group chat and profile. When you report an account we receive the report and the reason you selected. When you report a single message we also receive an identifier for that message and for the conversation, group or catalog it came from — but not the message itself, which stays encrypted. That identifier is what lets us act on one message rather than a whole account, and recognise repeat reports about the same person.

Intellectual Property

OnlyMenu IO, including its software, design and branding, belongs to Avante Studio LLC and is protected by copyright and other laws. These Terms grant you no right to our trademarks and no right to copy or redistribute the app.

Termination

You may stop using OnlyMenu IO and delete your account at any time from the Account tab. We may suspend or terminate an account that breaches these Terms, that creates legal risk, or where the law requires it. Where it is practical to do so we will tell you why.

Disclaimer of Warranties

OnlyMenu IO is provided "as is" and "as available", without warranty of any kind, whether express, implied or statutory, including any implied warranty of merchantability, fitness for a particular purpose, title or non-infringement. We do not warrant that the service will be uninterrupted, timely, secure or error free.

Limitation of Liability

To the fullest extent permitted by law, Avante Studio LLC is not liable for indirect, incidental, special, consequential or punitive damages, nor for lost data, profits, revenue or goodwill, arising from or relating to your use of OnlyMenu IO. Our total liability for any claim relating to the service will not exceed one hundred United States dollars (US$100). Some jurisdictions do not permit these limits, in which case they apply as far as the law allows.

Indemnification

You agree to indemnify and hold harmless Avante Studio LLC from any claim, demand, loss or expense, including reasonable legal fees, arising from your content, your use of OnlyMenu IO, or your breach of these Terms or of any law or third-party right.

Apple App Store Terms

This section applies if you obtained OnlyMenu IO from the Apple App Store. These Terms are between you and Avante Studio LLC only, not Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide maintenance or support. If the app fails to conform to any applicable warranty you may notify Apple, and Apple will refund the purchase price, if any; to the maximum extent permitted by law Apple has no other warranty obligation. Avante Studio, not Apple, is responsible for any claim relating to the app, including product liability, any failure to conform to legal or regulatory requirements, consumer protection claims, and any claim that the app infringes intellectual property rights. You confirm that you are not located in a country subject to a United States Government embargo or designated as terrorist supporting, and that you are not listed on any United States Government list of prohibited or restricted parties. You must also comply with any applicable third-party terms. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

Google Play Terms

This section applies if you obtained OnlyMenu IO from Google Play. These Terms are between you and Avante Studio LLC only, not Google. Google is not responsible for OnlyMenu IO or its content and has no obligation to provide support for it. Your use is also subject to the Google Play Terms of Service.

Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law rules. You and Avante Studio LLC submit to the exclusive jurisdiction of the state and federal courts located in California for any dispute that is not resolved in small claims court. Nothing here removes a mandatory consumer protection right you hold where you live.

Changes to These Terms

We may update these Terms. If a change is material we will update the date shown above and, where appropriate, tell you in the app. Continuing to use OnlyMenu IO after a change means you accept the updated Terms.
